SOUTHERN CALIFORNIA, CA. (Pain In The Pass) >> Beginning January 1, 2026 new California driving laws take effect. These are aim to make the roads safer.
Vehicular Manslaughter While Intoxicated:
Under Assembly Bill 1087 increases probation terms for those convicted of vehicular manslaughter or gross vehicular manslaughter while intoxicated from two years to between three and five years.
Ignition Interlock Devices:
Under AB 366 extends California’s statewide Ignition Interlock Device program for certain DUI offenders through Jan. 1, 2033. Drivers required to participate must use a breath-activated device that prevents a vehicle from starting if alcohol is detected.
Update on the “Slow Down, Move Over” Law:
Under AB 390 expands California’s “slow down, move over” law to require drivers to change lanes or slow down when approaching any stationary vehicle displaying hazard lights or warning devices like cones and flares. When you see flashing lights ahead—whether it’s red, blue, amber, or even just hazard lights just move over.
License Plate Obstruction:
The new law makes it an infraction, punishable by fines of up to $1,000, to manufacture in California products designed to obscure or interfere with the visual or electronic reading of license plates.
Off-Highway Electric Motorcycles:
Under SB 586 classifies off-highway electric motorcycles, commonly called eMotos, as off-highway motor vehicles. Rider must wear helmet and display DMV-issued off-road sticker plate.
Duplicate Driver’s License After Address Change:
Under SB 506, drivers who update their address with the DMV are allowed to request a duplicate driver’s license showing the new address.
Possession of Burglary Tools:
Under AB 486 – Makes it a misdemeanor to possess a key programming device, duplicating device, or signal extender with the intent to commit burglary. Violators may face up to six months in jail, a $1,000 fine, or both.
Highway Work Zone Speed Cameras:
Under AB 289 – Authorizes Caltrans to run a speed safety pilot program using fixed or mobile radar or laser systems. Violations are recorded and mailed to registered vehicle owners with procedures in place for appeals and review.
Electric Bicycle Equipment:
Under AB 544 – Requires electric bicycles to be equipped with a red reflector or a red light with a built-in reflector at all times, not just at night. Also allows minors to be cited for helmet violations and complete a CHP-developed online safety course to meet educational requirements.
Lowered School Zone Speed Limits:
Under AB 382 – Allows local authorities to reduce speed limits in school zones from 25 to 20 mph by ordinance or resolution through January 1, 2031. After that, the 20-mph limit becomes automatic if signs are posted.
